On August 1, 2023, Brazil will become the second country in Latin America (after Mexico) to be a party to the Hague Agreement Concerning the International Registration of Industrial Designs (Hague System).
The Hague System, which now covers 96 countries, provides a centralized mechanism for registering designs simultaneously in member countries by filing a single application in one language with one set of fees.
Brazil’s instrument of accession includes a number of declarations, such as a mandatory indication of the creator of the design, whereby a standard statement is sufficient for this purpose, and a maximum duration of protection by the law of Brazil of 25 years in respect of industrial designs.
With a population of more than 124 million and a GDP of $1.6 trillion (2021), Brazil is the largest economy in Latin America. For EU designers or business owners, the accession of Brazil to the Hague System makes it possible to secure international design protection in Brazil in a practical and cost-efficient way, facilitating business expansion into Latin America.
